Effective 2026-10-19. These terms govern every purchase of the SmartestDesk Examiner Exam Simulation, Study Manual, or Bundle (together, “the Product”).
A licence to use a digital study product: a timed practice-exam simulation, a separate self-study practice exam, analysis tools, cue cards, a coaching module and a study manual, prepared to resemble the structure, timing and subject blueprint of the FMCSA Medical Examiner Certification Test as published by FMCSA. Access is delivered by an access code shown on the confirmation page after payment, and the Product is read on screen.
SmartestDesk and its SmartestDesk Examiner line are not affiliated with, endorsed by, or connected to the Federal Motor Carrier Safety Administration (FMCSA), the National Registry of Certified Medical Examiners, Prometric, PSI, or any testing organization. Every question in the Product is an original work written for it; the Product contains no questions taken from the FMCSA certification test. “FMCSA” and “National Registry of Certified Medical Examiners” are the names of a United States government agency and program and are used only to identify the examination the Product prepares you for.
Passing the certification test depends on your own preparation, your accredited training, and the test as administered on the day. We make no promise, express or implied, that you will pass, obtain any score, or be listed on the National Registry. The Product is a study aid, not a credential.
Because the Product is digital and its value is delivered in full the moment the access code is used, all sales are final once the code has been entered. If a code has never been used, write to support@smartestdeskexaminer.com within 7 days of purchase and we will cancel the order and refund it through Stripe.
Your access code is personal to you and is bound to the first computer on which it is used. It may be moved to another computer through the Product’s own transfer step, using your password, not more than once in any 30 days; the previous computer then stops working. Support may reset the binding where a move is blocked. Sharing the code, reselling it, using it to prepare more than one candidate, or running it on more than one computer at a time is a breach of these terms and ends your access without refund.
The Product is read on screen. Printing, saving, downloading, screen capture, copying, scraping, recording, and transmission of any question, answer, rationale, chapter, card or image are prohibited and are technically restricted. Every page is watermarked with your licence. We may suspend or terminate access, without refund, where these restrictions are circumvented, and we may pursue any remedy the law allows.
Every question, rationale, explanation, chapter, diagram, the SmartestDesk Examiner name, logo and the software of this site are © 2026 Richard G. Clark and SmartestDesk, all rights reserved. You may read and use them for your own preparation only. You may not copy, publish, scrape, train a machine-learning system on, or resell any part of them. Quotations from Title 49 of the Code of Federal Regulations and from FMCSA publications are works of the United States Government and are not claimed.
The Product is written from the current text of 49 CFR Parts 390–391 and the current FMCSA Medical Examiner’s Handbook and is reviewed against them; the review date is shown in the Product. Regulations change; where a rule changes after your purchase we update the Product, but you remain responsible for confirming the standard in force on your test date.
The Product teaches the FMCSA standard for examination purposes. It is not medical advice for any patient and not legal advice to any person. The author is a Legal Strategist and Consultant and is not a licensed attorney; nothing here creates a professional relationship of any kind.
Access runs 12 months from purchase. We may suspend the Product for maintenance, or suspend or terminate a licence for breach of sections 5 or 6. Support is by email at support@smartestdeskexaminer.com; we answer within two business days.
Payments are processed by Stripe. We never see or store your card number. We keep your email, the last four digits of the card you paid with (so you can recover a lost code), your access code, the computer identifier the licence is bound to, and your study progress, and use them only to run the Product. We never hold your full card number. Prices are in US dollars.
These terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law rules.
